
In yet another victory for left-wing domestic terrorists, U.S. District Judge Mustafa Kasubhai has ordered the protective perimeter fencing torn down within 48 hours, despite months of violent Antifa attacks, shattered windows, a lobby breach, over $200,000 in damage, and an active FBI manhunt for the rioters.
The ruling, issued Monday, June 22, 2026, by Biden nominee Judge Kasubhai, claims the fencing violates the First Amendment by blocking access to the upper “Free Speech Plaza.”
The judge rejected the government’s offer of a permit system and alternative spaces, insisting the area must remain fully open for “spontaneous” demonstrations.
This is the same plaza that Antifa and aligned anarchist groups have repeatedly turned into a war zone.

Judge Mustafa Kasubhai announced in court Monday that he was granting a request for a preliminary injunction against the federal government.
He said the fence could be reinstalled in the future if it allowed more access to the upper courtyard.
Kasubhai said while the government has an interest in protecting its building, the courtyard is a “traditional public forum.”
The government blocked off the area in April after a riot was declared at a protest in January.
In September 2025, masked Antifa terrorists surrounded the Federal Building in Eugene to protest ICE. They blocked all normal entrances and exits, pounded on doors and windows, and trapped federal employees inside, forcing them to find alternative ways out.
Federal police made arrests as the domestic terrorist group attempted to lay siege to the facility just one day after President Trump signed an executive order designating Antifa a domestic terrorist organization.
Then came the even more brazen January 30, 2026 riot. A crowd of 400-500 anti-ICE agitators turned violent. They broke multiple windows, spray-painted federal property, threw rocks at law enforcement, and some actually breached the lobby. Eugene police declared a riot.
Federal employees were trapped inside, terrified of what would happen if the building was fully overrun. The facility was evacuated and closed for 10 days.
Damage exceeded $200,000. The FBI launched a manhunt, released video of the rioters, and offered up to $5,000 rewards for information leading to arrests and convictions for the destruction of government property. At least one suspect has already been federally charged with depredation of federal property.
President Trump publicly condemned the attack, blasting local police for standing down and vowing that his administration would not allow federal buildings to be damaged by “Insurrectionists, Agitators, and Anarchists.”
The fence was the direct, necessary response to this violence.
Installed in late April 2026 at a cost of nearly $270,000, the perimeter fencing was put up after the building’s Facility Security Committee determined it was required to stop future breaches, protect employees (including veterans using the on-site VA services), and give crews time to install riot-proof glass and harden the facade.
The General Services Administration said the barrier was temporary — expected to stay up roughly two years while repairs and security upgrades were completed.
Left-wing activists represented by the Civil Liberties Defense Center sued anyway, claiming the fence was really just a sneaky way to suppress their speech. Judge Kasubhai bought the argument. He ordered the entire perimeter fence removed within 48 hours.
While he left open the possibility of some limited fencing on breezeways, the main barrier protecting the upper plaza must go.
