A federal judge on Monday dismissed the criminal cases against James Comey and Letitia James.

The case was dismissed without prejudice which means it is only dismissed temporarily.

Judge Cameron McGowan Currie, a Clinton appointee ruled that US Attorney Lindsey Halligan was invalidly appointed:

For the reasons set forth above, it is hereby ORDERED AND ADJUDGED as follows:

1. The appointment of Ms. Halligan as Interim U.S. Attorney violated 28 U.S.C. § 546 and the Appointments Clause of the U.S. Constitution.

2. All actions flowing from Ms. Halligan’s defective appointment, including securing and signing Mr. Comey’s indictment, were unlawful exercises of executive power and are hereby set aside.

3. The Attorney General’s attempts to ratify Ms. Halligan’s actions were ineffective and are hereby set aside.

4. Mr. Comey’s motion to dismiss the indictment (ECF No. 60) is granted in accordance with this order.

5. The indictment is dismissed without prejudice.

6. The power to appoint an interim U.S. Attorney for the Eastern District of Virginia pursuant to 28 U.S.C. § 546 during the current vacancy lies with the district court until a U.S. Attorney is nominated by the President and confirmed by the Senate under 28 U.S.C. § 541.

A grand jury in the Eastern District of Virginia indicted former FBI Director James Comey in September. He was indicted on two counts – false statements and obstruction of a congressional proceeding.

James Comey filed a motion to dismiss his federal criminal case on, claiming “vindictive prosecution.”

Comey also challenged the appointment of US Attorney Lindsey Halligan.

James Comey cited two other cases as he challenged Halligan’s appointment as Interim US Attorney for the Eastern District of Virginia.

New York Attorney General Letitia James was indicted by a federal grand jury in the Eastern District of Virginia last month.

According to the DOJ, Letitia James was charged with two crimes: Bank Fraud under 18 U.S.C. Section 1344 and False Statements to a Financial Institution under 18 U.S.C. Section 1014.

Letitia James also filed a motion to dismiss the federal indictment arguing that US Attorney Lindsey Halligan’s appointment as interim US Attorney is in violation of the Appointments Clause of the United States Constitution.

Letitia James also asked Judge Jamar Walker, the judge overseeing her case, to consolidate her motion challenging the appointment of Halligan with James Comey’s motion in a separate case – and he granted her request.

Pam Bondi recently jumped into action and retroactively gave Lindsey Halligan a new position of “special attorney” in response to Comey’s effort to remove Halligan.

“On September 22, 2025, I exercised the authority vested in the Attorney General by 28 U.S.C. § 546 to designate and appoint Lindsey Halligan as the United States Attorney for the Eastern District of Virginia,” Bondi wrote in a new order dated October 31.

“For the avoidance of doubt as to the validity of that appointment, and by virtue of the authority vested in the Attorney General by law, including 28 U.S.C. § 509, 510, and 515, I hereby appoint Ms. Halligan to the additional position of Special Attorney, as of September 22, 2025, and thereby ratify her employment as an attorney of the Department of Justice from that date going forward,” Bondi said.

As a “special attorney,” Halligan has the authority to conduct legal proceedings before judges and magistrates.

“As Special Attorney, Ms. Halligan has authority to conduct, in the Eastern District of Virginia, any kind of legal proceeding, civil or criminal, including grand jury proceedings and proceedings before United States Magistrates and Judges,” Bondi wrote.

Judge Currie dismissed both cases at once on Monday.

Letitia James celebrated.
