A New York DoorDash driver who went viral last fall after filming a customer unconscious and partially naked inside his own home and then posting the video on TikTok while claiming she was the victim has now been formally indicted by a grand jury on two felony counts.
Olivia R. Henderson, 23, of Oswego, faces charges of unlawful surveillance in the second degree and dissemination of an unlawful surveillance image in the first degree, both Class E felonies under New York law.
Henderson pleaded “Not Guilty” on Friday morning.

Each count carries a maximum of four years in prison.
The incident occurred on October 12, when Henderson made a DoorDash food delivery to a residence in Oswego.

According to the Oswego Police Department, she recorded the male customer, who was passed out on his couch with the door slightly ajar after drinking alcohol, with his pants and underwear pulled down around his ankles.
Henderson nudged the door open to film him.
Police have stated the recording was made without the man’s consent, and Henderson later posted the video on TikTok, where it quickly amassed millions of views.
Henderson is accused in court documents of “degrading” the victim by filming “intimate parts of such person at a place and time when such person has a reasonable expectation of privacy, without such person’s knowledge or consent.”
Henderson initially claimed in her TikTok post that she had been sexually harassed during the delivery.

Oswego police investigated those allegations and found no evidence to support them.
The customer cooperated with authorities and was determined to have simply passed out from alcohol consumption in the privacy of his own home.

DoorDash immediately deactivated Henderson’s account after learning she had shared the customer’s private video, citing violations of its privacy policies.
Henderson’s next court date is scheduled for June.
